Nithyananda case to CID
BANGALORE: The High Court on Tuesday refused to stay the investigation against Swami Nithyananda who is facing charges of cheating and hurting religious sentiments.While hearing two separate petitions by Nithyananda, Justice Arali Nagaraja issued notice to the State police and directed them to produce the probe papers. The court posted the matter for hearing to Thursday.The swami contended that the complaint was filed on the basis of hearsay and the averments in the complaint were false. The complaint is in the form of a memorandum and it does not specify any cognisable offence, he said. The complainant is neither a power of attorney holder nor an authorised person of the aggrieved parties. So the registration of the case was illegal, he said.The investigating agency should have conducted a preliminary inquiry before registering the case, which it failed to do. Besides, the registration of cases under section 377 (offence for unnatural sex) and 376 (rape) are not maintainable as the aggrieved parties have not filed the complaint, the petitioner’s counsel argued.The video tape was manipulated to extort money from the ashram, the petitioner alleged.
Mar 17: Action can be expected soon in the Swami Nithyananda sex scandal case as Karnataka police, which has received the required information from Tamil Nadu, is busy translating the documents besides mulling the transfer of the case to CID.
Speaking to the media on Tuesday, Mar 16, Additional DGP (Law and Order) A R Infant informed that cases against the spiritual guru will be re-registered by the Ramanagaram police as the ashram where the sex tape was recorded comes under Ramanagaram jurisdiction.

As of now the police are translating all papers sent by Tamil Nadu police into Kannada for filing fresh cases against the godman.
Since the nature of the case is complex, the police is likely to transfer the case to CID.
As per the latest reports, a probe is likely to be launched into the case filed by Nithya Dharmananda alias Lenin in Tamil Nadu alleging that Nithyananda's disciples were plotting to kill him.
"The case filed by Nithya Dharmananda alias Lenin in Chennai was transferred to Bidadi police through Ramanagaram District Superintendent of Police late last evening for re-registration," Additional DGP (Law and Order), A R Infant told a news agency.
Besides this, the police will also be checking the CDs and the footage aired in the media to check if the CD was doctored or was genuine
